These Terms and Conditions ("Terms") govern your access to and use of all services, programs, and resources provided by Equip4Life Pty Ltd ("we", "us", "our", or "Equip4Life") through our website www.equip4life.com.au and associated platforms. By accessing our website, registering for programs, or using our services, you agree to be bound by these Terms.

1. IMPORTANT DISCLAIMER AND LIMITATIONS

1.1 General Nature of Information and Advice

ALL INFORMATION AND ADVICE PROVIDED BY EQUIP4LIFE IS GENERAL IN NATURE AND NOT TAILORED TO YOUR INDIVIDUAL CIRCUMSTANCES.

This applies to ALL Equip4Life services:  Life! Program, WELL Community, private consultations, workplace programs, school workshops, seminars, website content, educational materials, and any other service we provide.

What "general in nature" means:

  • Information is NOT tailored to your specific medical history, health conditions, medications, allergies, or personal situation
  • Information is designed for generally healthy adults and may not be suitable or safe for everyone
  • Group programs provide general education that cannot account for each participant's unique needs or contraindications
  • Examples, recommendations, and strategies are general only - they may not be appropriate or safe for you
  • Even private consultation advice is based on information you disclose and may need modification by your medical practitioner

Examples to Illustrate General vs Specific Advice:

Example 1 - Food Recommendations:

If we recommend "consume walnuts for good fats and protein," this is general nutritional education. This does NOT apply if you: have nut allergies, have been advised to avoid nuts by your doctor, have medical conditions making nuts unsafe, take medications that interact with nuts, or have any other reason nuts are unsuitable. It is YOUR responsibility to assess if this general information is safe for you.

Example 2 - Exercise Recommendations:

If we suggest "30 minutes of brisk walking daily," this may NOT be safe if you: have cardiovascular disease, joint problems, have been sedentary, have diabetes complications, take heart/BP medications, or your doctor has advised against this activity level.

Example 3 - Portion Control:

If we recommend "reduce portions using smaller plates," this may NOT be appropriate if you: have eating disorder history, have specific caloric requirements, are pregnant/breastfeeding, or this may trigger unhealthy eating behaviors.

YOUR RESPONSIBILITY:

  • Assess if general information is safe for YOUR situation
  • Consult your medical practitioner before implementing changes
  • Do NOT follow advice you know or suspect may be unsuitable for you
  • Seek individualized advice when needed

1.2 Not a Substitute for Medical Advice

EQUIP4LIFE SERVICES DO NOT REPLACE INDIVIDUALIZED MEDICAL ADVICE FROM YOUR MEDICAL PRACTITIONER.

You acknowledge that: 

  • Our practitioners (Dietitians and Exercise Physiologists) provide allied health services within their scope - NOT medical diagnosis or treatment
  • NO information from Equip4Life constitutes medical advice, diagnosis, treatment, or creates a doctor-patient relationship
  • You MUST consult YOUR medical practitioner before: participating in programs, making dietary changes, starting exercise, implementing recommendations, or changing medications
  • Your medical practitioner is the ONLY one who can provide medical advice tailored to your complete medical history and current status
  • Our practitioners are NOT medical doctors and cannot diagnose conditions or prescribe treatments

What Equip4Life CAN do:

  • Provide evidence-based nutrition and exercise education within allied health scope
  • Deliver group education on healthy lifestyle and diabetes prevention
  • Offer motivational support and referrals when needed

What Equip4Life CANNOT do:

  • Diagnose medical conditions or prescribe medications/treatments
  • Provide medical advice, psychological treatment, or emergency services
  • Replace your medical practitioner or guarantee outcomes

1.3 Individual Responsibility

YOU ARE SOLELY RESPONSIBLE FOR YOUR HEALTH DECISIONS AND ALL OUTCOMES.

You accept full responsibility for: 

  • Determining if services are suitable and safe for you
  • Obtaining medical clearance and advice before participating
  • Disclosing ALL relevant health information to practitioners
  • Deciding whether to implement recommendations
  • Monitoring your health and stopping immediately if you have concerns
  • ALL outcomes (positive or negative) from participation

1.4 No Guarantees

Equip4Life makes NO guarantees regarding weight loss, health improvements, disease prevention, fitness changes, or any specific outcomes or timeframes. Individual results vary significantly based on genetics, health status, adherence, medications, lifestyle factors, and many variables beyond our control. What works for one person may not work for another.

1.5 When to Seek Immediate Medical Attention

STOP IMMEDIATELY and seek medical attention if you experience: chest pain, severe breathlessness, dizziness, unusual heart rate, severe pain, nausea during exercise, extreme fatigue, or any concerning symptoms. Call 000 for emergencies.

1.6 Mandatory Medical Clearance

You MUST obtain medical clearance before participating if you have: ANY medical conditions, take ANY medications, have cardiovascular/diabetes/kidney disease, are pregnant/breastfeeding, have eating disorder history, have physical limitations, are over 40 and sedentary, have family history of heart disease, or experience symptoms during exercise. We reserve the right to require clearance documentation.

1.7 Online and Telehealth Services

Many Equip4Life services are delivered online via platforms such as Zoom, Kajabi, and Livestorm. You acknowledge and accept that online and telehealth services have inherent risks and limitations, including but not limited to:

  • Technology failures or interruptions
  • Reduced ability to observe physical condition
  • Delays in communication
  • Potential security or privacy risks beyond our reasonable control

You accept these risks and agree that Equip4Life is not responsible for interruptions, technical failures, or limitations inherent in online service delivery.

1.8 Physical Activity and Exercise Risk Acknowledgment

Participation in physical activity, exercise, or lifestyle modification carries inherent risks, including but not limited to injury, illness, adverse health events, or in rare cases serious harm.

By participating in Equip4Life programs, you: 

  • Voluntarily assume all inherent risks associated with participation
  • Confirm you are medically able to participate or have obtained appropriate medical clearance
  • Agree to stop immediately and seek medical advice if symptoms occur

To the maximum extent permitted by law, you acknowledge that Equip4Life is not responsible for injuries or adverse outcomes arising from participation where reasonable care has been exercised.

1.9 Acknowledgment

By using Equip4Life services, you acknowledge you have read and understood this section, accept that services provide general education (not medical advice), accept responsibility for obtaining medical clearance, and accept full responsibility for your health decisions and outcomes.

2. SERVICES PROVIDED

2.1 Overview

Equip4Life Pty Ltd (ABN 56 141 113 260) provides evidence-based health and wellbeing services delivered by Accredited Practising Dietitians and Accredited Exercise Physiologists.

2.2 Life! Program

Victorian Government-funded program coordinated by Diabetes Victoria for diabetes prevention. Includes group sessions (online via Livestorm and in-person) and individual consultations. FREE to eligible participants. We collect and report participant data to Diabetes Victoria and government agencies (de-identified where possible). Participants consent to data use for program evaluation and reporting.

2.3 WELL Community

Subscription-based online membership providing weekly live webinars for weight loss support. Delivered via Kajabi platform. Weekly subscription fee applies. Separate detailed Terms and Conditions available at www.equip4life.com.au/wellcommunity/terms (which apply in addition to these Terms).

2.4 Private Consultations

One-on-one consultations with Dietitians/Exercise Physiologists for personalized advice. Available as: (a) fee-for-service (paid by client), or (b) Medicare bulk-billed under Enhanced Primary Care (EPC) or Chronic Disease Management (CDM) plans. Delivered via Zoom, phone, or in-person.

2.5 Other Services

  • Workplace Wellness: Corporate health programs paid by organizations
  • Information Seminars: Free community health talks
  • Educational Resources: Handouts, recipes, guides, website content

2.6 Third-Party Platforms

We use third-party platforms to deliver services and manage operations. By using our services, you consent to your information being processed by:

  • Salesforce: Customer relationship management and data management
  • Jotform: Form collection and data entry
  • Mailchimp: Email marketing and communications
  • Kajabi: WELL Community platform and member portal
  • Livestorm: Life! Program online sessions
  • Zoom: Video consultations
  • Stripe & Square: Payment processing

These platforms have their own terms of service and privacy policies. We select reputable providers complying with Australian privacy standards. We comply with all platform terms of use and are not responsible for platform operations beyond our control.

Equip4Life is not responsible for temporary outages, technical failures, data interruptions, or service limitations caused by third-party platforms that are beyond our reasonable control.

2.7 School Programs and Minors

For services involving children under 18 years (including school workshops), participation requires consent from a parent, guardian, or authorised school representative.

Equip4Life provides general educational content only and does not assume supervisory responsibility for children outside the agreed program delivery. Schools and parents remain responsible for supervision, medical needs, and duty of care unless otherwise agreed in writing.

3. ELIGIBILITY AND YOUR RESPONSIBILITIES

3.1 Eligibility

  • 18+ years (unless program-specific with parental consent)
  • Capable of entering binding contracts
  • Provide accurate, complete information
  • Meet program-specific requirements
  • Reside in Australia (or specific state/region)

3.2 Account Security

Responsible for:  login credentials, account activities, not sharing access, notifying of unauthorized access, keeping contact info current, checking email regularly.

3.3 Participation

Agree to:  attend punctually; provide 24-48 hours cancellation notice; engage respectfully; complete assessments; communicate openly about health; ask questions when unsure; notify of health changes.

3.4 Mandatory Health Information Disclosure

FOR YOUR SAFETY, YOU MUST FULLY DISCLOSE ALL RELEVANT HEALTH INFORMATION.

You MUST disclose: 

  • Medical conditions: ALL diagnoses (diabetes, cardiovascular disease, kidney/liver disease, thyroid disorders, GI disorders, autoimmune conditions, respiratory conditions, mental health, eating disorders, cancer history, etc.)
  • Medications: ALL prescription drugs, OTC medications, supplements, vitamins, herbal remedies (include dosages)
  • Allergies: Food allergies (nuts, shellfish, dairy, eggs), medication allergies, intolerances
  • Pregnancy/Breastfeeding: Current pregnancy, breastfeeding, trying to conceive
  • Eating Disorder History: Anorexia, bulimia, binge eating disorder, restrictive eating, body dysmorphia (CRITICAL)
  • Physical Limitations: Injuries, disabilities, conditions affecting activity
  • Recent Medical Events: Surgeries, procedures, hospitalizations
  • Family History: Cardiovascular disease, diabetes, sudden cardiac death
  • Doctor's Restrictions: Any advice, clearances, or restrictions from your medical practitioner
  • Changes: ANY health changes during participation

FAILURE TO DISCLOSE may:  compromise your safety, prevent appropriate care, increase health risks, void protections in these Terms.

4. DATA COLLECTION, USE & PRIVACY

BY USING OUR SERVICES, YOU CONSENT TO DATA COLLECTION, USE, STORAGE, AND DISCLOSURE AS DESCRIBED.

4.1 Information We Collect

  • Personal: Name, contact details, DOB, emergency contacts, payment info
  • Health: Medical conditions, medications, allergies, measurements, pathology, dietary intake, activity, goals, progress notes, assessments
  • Sensitive: Mental health, eating disorder history
  • Participation: Attendance, engagement, questions submitted

4.2 How We Use Information

  • Providing and improving services
  • Assessing eligibility and tailoring recommendations
  • Communications, payment processing, progress monitoring
  • Legal compliance and record-keeping (minimum 7 years)
  • Quality improvement, research (de-identified data)

4.3 Storage

Securely stored in:  electronic systems (password-protected, encrypted); third-party platforms (Salesforce, Kajabi, etc.); restricted access; regular backups; 7-year minimum retention.

4.4 Disclosure

May disclose with:  your consent; to Diabetes Victoria/Victorian Government (Life! Program - de-identified/aggregated); to your GP (with consent); to third-party platforms (under confidentiality); when required by law; in emergencies.

4.5 Your Rights

4.6 Life! Program Specific Consent

Life! participants consent to:  detailed health data collection; de-identified data use for evaluation/research; reporting to Diabetes Victoria/Government; quality assurance reviews.

4.7 Session Recording and Replay Consent

Some group sessions, webinars, and online programs may be recorded for quality assurance, training, and participant replay access.

By participating in online sessions, you acknowledge and consent that:

  • Sessions may be recorded
  • Your name, submitted questions, or participation may be visible in recordings
  • Recordings may be made available to other registered participants

If you do not wish to be identifiable, you should keep your camera off and avoid using identifying information in chat functions.

5. SMS & EMAIL COMMUNICATIONS

5.1 SMS Messages

By providing your mobile number, you consent to receive SMS including: appointment reminders, notifications, updates, promotional messages. Message frequency varies. Standard SMS rates apply (carrier charges). Opt-out: Reply STOP or email [email protected]. Essential messages may still be sent.

5.2 Email Marketing

By providing your email, you consent to receive emails via Mailchimp including: educational content, tips, program info, offers, updates. Unsubscribe: Click link in email OR email [email protected]. Unsubscribing doesn't affect essential communications.

5.3 Essential Communications

Essential service communications sent regardless of marketing preferences: appointment confirmations, schedule changes, billing, T&C updates, important announcements. Cannot opt-out while active participant.

6. FEES, PAYMENT & CANCELLATIONS

6.1 Fees

  • Life! Program: FREE (government-funded)
  • WELL Community: Weekly subscription (see separate T&Cs)
  • Private Consultations: Fee-for-service OR Medicare bulk-billed (EPC/CDM)
  • Workplace/School Programs: Contracted

6.2 Payment

Processed via Stripe/Square (credit/debit), direct transfer, or invoice. All fees include GST where applicable. For subscriptions, recurring payments processed automatically.

By purchasing a subscription service, you expressly authorise Equip4Life to automatically charge your nominated payment method at the stated billing frequency until you cancel in accordance with the applicable cancellation process.

For invoices, payment due within 30 days.

6.3 Late/Failed Payments

Failed payments:  email notification, access may be suspended. Overdue invoices: late fees/interest (max RBA cash rate + 2% p.a.), debt collection, legal action. You're responsible for recovery costs.

6.4 Cancellations & Refunds

  • Private Consultations: 24-hour notice required or fee may be forfeited. Repeated late cancellations may require advance payment.
  • Group Programs: Program-specific policies. Generally no refunds within 7 days of commencement.
  • Refunds: Assessed case-by-case. Generally not provided for partially completed services unless exceptional circumstances.
  • Australian Consumer Law rights preserved.

7. INTELLECTUAL PROPERTY & USER CONDUCT

7.1 Intellectual Property

ALL materials (videos, handouts, recipes, presentations, website content) are Equip4Life's intellectual property. Limited personal-use license only. You may NOT: copy, share, distribute, use commercially, record/download videos (unless permitted), share login/session links, modify materials. Permitted: Handwritten notes, screenshots for personal reference only (not sharing). Violations: Immediate termination without refund, legal action.

7.2 User Conduct

Must:  Engage respectfully, respect others' privacy. Must NOT: Harass, bully, use offensive language, disrupt sessions, provide medical advice to others, promote products/services, use unlawfully. Violations: Warnings, removal, termination without refund.

8. LIMITATION OF LIABILITY & INDEMNITY

8.0 Not an Emergency Service

Equip4Life does not provide emergency, crisis, or acute medical services.

If you experience a medical emergency, call 000 immediately or seek urgent medical care.

8.1 Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, EQUIP4LIFE IS NOT LIABLE FOR HEALTH OUTCOMES, INJURIES, ADVERSE EFFECTS, OR DAMAGES ARISING FROM PARTICIPATION.

Equip4Life, its directors, employees, contractors, and affiliates are not liable for: (a) direct, indirect, incidental, consequential, or punitive damages; (b) loss of profits, revenue, data; (c) personal injury, illness, health complications; (d) damages from use of or inability to use services.

8.2 No Warranties

NO warranties regarding:  accuracy, reliability, completeness of information; suitability for your circumstances; specific outcomes or results; uninterrupted access. Services "AS IS" and "AS AVAILABLE."

8.3 Indemnity

You indemnify and hold harmless Equip4Life from claims, damages, losses, liabilities, costs, expenses (including legal fees) arising from: your use of services; Terms violations; third-party rights violations; any health outcomes.

8.4 Australian Consumer Law

NOTHING excludes rights under Australian Consumer Law (ACL) that cannot be lawfully excluded. Where ACL implies warranties that cannot be excluded, liability limited to: re-supply of services or payment of re-supply cost, OR fees paid in 12 months preceding event.

9. SERVICE MODIFICATIONS & TERMINATION

9.1 Modifications

We reserve right to modify, update, suspend, or discontinue services anytime, subject to commitments and notice. Material changes reducing service value: 30 days' notice.

9.2 Termination by Equip4Life

May terminate/suspend if:  Terms breach, non-payment, prohibited conduct, safety risks, services unsuitable for circumstances.

9.3 Termination by You

May terminate anytime by written notice. Refund eligibility per Section 6.4.

10. DISPUTE RESOLUTION & GOVERNING LAW

10.1 Dispute Resolution

Contact first:  [email protected] | 0452 205 433. Good faith resolution within 30 days. If unresolved, mediation through mutually agreed mediator or Resolution Institute. Each party bears own costs unless agreed.

10.2 Governing Law

Victorian law. Victorian courts have exclusive jurisdiction.

11. GENERAL PROVISIONS

  • Entire Agreement: These Terms, Privacy Policy, program-specific terms constitute entire agreement
  • Severability: If provision invalid, modified or severed; remaining provisions continue
  • Waiver: Non-enforcement doesn't waive rights. Waivers must be written/signed
  • Assignment: You can't assign without consent. We may assign to successors
  • Force Majeure: Not liable for circumstances beyond reasonable control
  • Notices: Via email (deemed received 24 hours after). Keep email current
  • Updates: Material changes notified 14 days before effective. Continued use = acceptance

ACKNOWLEDGMENT

By using Equip4Life services, you acknowledge: 

  • Read and understood these Terms
  • Services provide general education, NOT individualized medical advice
  • Services DO NOT replace medical advice from your medical practitioner
  • Accept responsibility for obtaining medical clearance and advice
  • Accept full responsibility for your health decisions and ALL outcomes
  • Consent to data collection, use, storage, disclosure as described
  • Agree to be bound by all provisions
