Usage Information: Session attendance, replay views, content accessed, time spent on platform

Communications: Emails, messages, feedback, and any other communications you send to us

Directly from you: When you register for WELL, update your profile, attend sessions, submit questions, or contact us

Automatically: Through cookies, analytics tools, and our platform provider (Kajabi) when you use our website or access WELL content

From third parties: From payment processors (Stripe), referral sources, or other service providers who assist in delivering WELL

Where reasonable and practical, we will collect personal information directly from you. If we receive your information from a third party, we will take reasonable steps to notify you.

3. Why We Collect and Use Personal Information

We collect and use your personal information for the following purposes:

(a) To provide and deliver WELL services, including live and recorded sessions

(b) To manage your membership, account, and billing

(c) To communicate with you about WELL, including session reminders, content updates, and membership information

(d) To respond to your questions, feedback, or support requests

(e) To improve and personalize WELL content and your experience

(f) To analyze usage patterns and enhance our services

(g) To send marketing communications about WELL or related Equip4Life services (with your consent, as described below)

(h) To comply with legal obligations, including taxation and record-keeping requirements

(i) To protect our rights, property, safety, and the safety of our members and staff

Marketing Communications: We may send you marketing emails about WELL updates, new features, or related Equip4Life services. You can unsubscribe at any time by clicking the unsubscribe link in any marketing email or by contacting us. Even if you unsubscribe from marketing, we will still send you essential service communications (e.g., billing notifications, session updates).

4. Sensitive Information and Health Data

Sensitive information includes health information, which we collect as part of WELL to provide personalized weight loss education and support.

We will only collect, use, or disclose sensitive information:

(a) With your consent

(b) For the primary purpose of providing WELL services

(c) For directly related secondary purposes that you would reasonably expect

(d) Where required or authorized by law

By registering for WELL and providing health information, you consent to our collection and use of this sensitive information for the purposes described in this Privacy Policy.

5. How We Disclose Personal Information

We may disclose your personal information to:

Service Providers: Third parties who assist us in delivering WELL, including:

  • Kajabi (platform hosting and member management)
  • Stripe (payment processing)
  • Email service providers (communications)
  • Analytics providers (Google Analytics or similar)

Professional Advisors: Lawyers, accountants, auditors, or other professional advisors who assist us

Legal Authorities: Government agencies, regulators, or law enforcement when required or authorized by law

We do NOT sell, rent, or trade your personal information to third parties for their marketing purposes.

All third-party service providers are required to protect your personal information and use it only for the purposes we specify.

Some of our service providers are based overseas or store data on servers located outside Australia. Your personal information may be disclosed to:

  • United States (Kajabi, Stripe, and other service providers)
  • Other countries where cloud storage or service infrastructure is located

By using WELL, you consent to the disclosure of your personal information to overseas recipients for the purposes described in this Privacy Policy.

7. Session Recordings and Content

WELL sessions (whether live or pre-recorded) are recorded and made available to members for a limited time (currently 7 days).

Session recordings:

  • Are stored securely on our platform (Kajabi)
  • Are accessible only to active paying members during the 7-day availability period
  • Are automatically deleted from member access after 7 days
  • May be retained by Equip4Life for quality assurance, training, or record-keeping purposes

If you submit questions or comments during a session (whether through chat, Q&A submission, or verbally during a live session), your question may be included in the session recording. Questions are typically answered anonymously unless you specifically identify yourself.

Session recordings are our intellectual property and are protected under our Terms and Conditions. Recording, downloading, or sharing session content is strictly prohibited.

8. How We Protect Your Personal Information

We take the security of your personal information seriously and implement reasonable physical, technical, and administrative safeguards to protect it from misuse, interference, loss, unauthorized access, modification, or disclosure.

Our security measures include:

  • Secure data transmission using encryption (SSL/TLS)
  • Secure storage on protected servers
  • Access controls limiting who can view or use your information
  • Regular security assessments and updates
  • Password-protected accounts with secure authentication
  • Payment information processed through PCI-DSS compliant payment gateway (Stripe)

While we strive to protect your personal information, no method of electronic storage or transmission is 100% secure. You are responsible for maintaining the confidentiality of your account login credentials.

9. How Long We Keep Your Personal Information

We retain your personal information for as long as necessary to fulfill the purposes described in this Privacy Policy, unless a longer retention period is required or permitted by law.

Specific retention periods:

Active Membership Data: Retained for the duration of your active membership

Health Information: Retained for 2 years after your membership ends, or longer if required for legal or professional liability purposes

Financial Records: Retained for 7 years from the date of transaction, in accordance with taxation requirements

Session Recordings: Member access removed after 7 days; recordings may be retained by Equip4Life indefinitely for quality assurance and business purposes

Marketing Data: Retained until you unsubscribe or request deletion

Technical/Cookie Data: Typically retained for 12-24 months depending on the cookie type

When personal information is no longer required, we take reasonable steps to destroy or permanently de-identify it.

10. Accessing and Correcting Your Personal Information

You have the right to:

(a) Request access to the personal information we hold about you

(b) Request correction of any inaccurate, incomplete, or out-of-date information

(c) Update your account information directly through your member portal

We will respond to your request within a reasonable timeframe (typically within 30 days). We do not charge a fee for access requests, but we may charge a reasonable administrative fee for providing copies of documents.

In some circumstances, we may not be able to provide access to certain information (e.g., if it would unreasonably impact another person's privacy, or if providing access would be unlawful). If we deny access, we will provide you with reasons for the refusal.

11. Deleting Your Account and Personal Information

Upon receiving a deletion request, we will:

(a) Cancel your WELL membership

(b) Remove your access to the member platform and session content

(c) Delete or de-identify your personal information where practicable

However, we may retain certain information where:

  • Required by law (e.g., financial records for 7 years for taxation purposes)
  • Necessary for legal claims or compliance purposes
  • Health information must be retained for 7 years in accordance with health industry standards
  • Information has been de-identified so it no longer identifies you personally

Please note that account deletion is permanent and cannot be reversed. You will lose access to all WELL content and any membership benefits.

12. Data Breach Notification

In the unlikely event of a data breach that is likely to result in serious harm to you, we will:

(a) Notify you as soon as practicable

(b) Notify the Office of the Australian Information Commissioner (OAIC) as required by law

(c) Provide information about the breach, recommendations for protecting yourself, and our response

We take all reasonable steps to prevent data breaches and respond promptly and appropriately if one occurs.

13. Cookies and Tracking Technologies

We use cookies and similar tracking technologies to enhance your experience on our website and platform.

What are cookies? Cookies are small text files stored on your device that help websites remember your preferences and track usage.

We may update this Privacy Policy from time to time to reflect changes in our practices, technology, legal requirements, or other factors.

Any changes will be posted on this page with an updated "Effective Date." Material changes will be communicated to active members via email or through the member platform.

Your continued use of WELL after changes take effect constitutes acceptance of the updated Privacy Policy.
